Each day approximately 2000 people die in the United Kingdom. Most of them without leaving a legally valid Will. In such a case your possessions are distributed according to the Law of Intestacy.


Married Couples: Your husband or wifewill inherit the first £125 000 of your estate (the value of your house may exceed this amount). The remainder going to your children, if you have any, or other relatives i.e. parents-in-law.

Unmarried Couples: Even if you have children together your partner may get nothing. Also, Fathers have no automatic legal right to look after their own children in the event of the mother's death.

Separated Couples: Your separated partner will be entitled to part of the property directly and an interest in the remainder.

Parents: For children under 18, the Courts will decide who is to bring up your children. This may not be who you would prefer.

Everyone: If you wish specific people or charities to receive certain items you need a Will to ensure that this happens.


Your Will is an ideal way to make provision, during your lifetime, to protect your family home.

Should you need Long Term Residential Care later in life, you may be able to prevent your family home being taken to pay for this care under the Community Care Act 1990.

If you are in business, similar arrangements might be of value to protect your family home should things not go financially well with the Business.


Provide for your family as your would wish. Particularly any handicapped children who may need extra care.

Reduce or eliminate your Inheritance Tax liability so that your family inherit more.

Appoint Guardians to ensure your children are cared for as you would wish.

If you have children from a previous relationship you may be concerned about what might happen if your partner remarries and your children are disinherited in favour of the new partner’s family.

Ensure that anyone not named in your Will is unable to make a successful claim upon your estate.


A Will gives you the opportunity to ensure that Executors who are competent and who you trust to look after your Estate when you die are properly appointed.

Should you become unable to look after your own financial affairs through illness, accident or old age who will do this for you? Ensure you give legal authority to the person you want to do this for you.

Express your preferences to doctors and family about medical treatment if you are unable to make a decision because of severe illness or accident

There is no point in making a Will if when the time comes it cannot be found. Ensure your Will is in a safe place along with any other legal documents (life insurance policies, Deeds to your property etc.) that you might have and that your executors know where that is.
